Terms of Service

These Terms of Service ("Terms") govern your access to and use of Rostiq, a cloud-based workforce management platform operated by Rostiq ("we", "us", or "our"). By registering a company account, creating an admin account, or using any part of the service, you agree to these Terms. If you do not agree, do not use Rostiq.
1. The Service
Rostiq provides tools for shift-based businesses to manage employees, track GPS-verified attendance, configure geofence work zones, calculate payroll, record payments, and generate reports. The service includes web-based admin access and mobile applications for attendance kiosks and management.
We may update, modify, or discontinue features at any time. We will make reasonable efforts to notify account administrators of material changes that affect core functionality.
2. Account Registration
To use Rostiq, a company representative must complete registration and create the first admin account. You represent that you have authority to bind your organisation to these Terms and that all registration information you provide is accurate and current.
You are responsible for maintaining the confidentiality of admin credentials and for all activity under your company account. Notify us immediately at security@rostiq.com if you suspect unauthorised access.
3. Your Responsibilities
As a company account holder, you agree to:
- Use Rostiq only for lawful workforce management purposes and in compliance with applicable employment, privacy, and labour laws
- Obtain any required employee notices or consents before collecting attendance, location, or payroll data through the platform
- Ensure employee records, PINs, roles, and access permissions are managed appropriately
- Configure geofence zones accurately to reflect legitimate work locations
- Not attempt to reverse engineer, scrape, overload, or interfere with the service or its security measures
- Not use Rostiq to harass employees, falsify attendance records, or misrepresent hours worked or amounts paid
4. Employee and Attendance Data
Your company controls the employee data entered into Rostiq, including names, contact details, attendance timestamps, GPS coordinates submitted at clock-in/out, payroll rates, and payment records. You are the data controller for employee information; Rostiq acts as a data processor on your behalf, as described in our Privacy Policy.
GPS-verified attendance relies on device location data. You are responsible for informing employees that location may be collected when they clock in or out, and for using this feature in a manner consistent with local law.
5. Payroll and Payments
Rostiq provides payroll calculation tools based on rules and rates you configure. Calculations, reports, and exports are provided for your convenience — they do not constitute legal, tax, or accounting advice. You remain solely responsible for verifying pay amounts, deductions, tax obligations, and compliance with award rates or collective agreements applicable to your workforce.
Payment records entered in Rostiq reflect transactions you report. Rostiq does not process employee bank transfers unless explicitly stated in a separate agreement.
6. Subscription and Fees
Access to Rostiq may be subject to subscription fees as presented during registration or in your service agreement. Fees are billed in accordance with the plan selected. We may change pricing for future billing periods with reasonable advance notice. Failure to pay may result in suspension or termination of access.
7. Intellectual Property
Rostiq, including its software, branding, documentation, and design, is owned by us and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service for your internal business operations during your subscription. You retain ownership of your company data.
8. Availability and Support
We aim to keep Rostiq available and reliable but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party outages, or circumstances beyond our control may cause temporary downtime. Support is available via support@rostiq.com.
9. Termination
You may stop using Rostiq at any time by contacting us to close your account. We may suspend or terminate access if you breach these Terms, fail to pay applicable fees, or use the service in a way that poses legal or security risk. Upon termination, your right to access the service ends. We will retain or delete your data in accordance with our Privacy Policy and applicable law.
10. Disclaimers
Rostiq is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that payroll outputs, attendance records, or reports will meet your specific regulatory requirements without your independent verification.
11. Limitation of Liability
To the maximum extent permitted by law, Rostiq and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities arising from your use of the service. Our total liability for any claim related to the service is limited to the fees you paid to us in the twelve (12) months preceding the claim.
12. Changes to These Terms
We may revise these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of Rostiq after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, unless mandatory local law requires otherwise.
